A subpoena in New Jersey is a writ issued by an attorney, government agency, or most often a court, to compel testimony by a witness or production of evidence under penalty for failure to comply. A.C.E. Process Servers are experienced in serving all types of subpoenas throughout New Jersey.
Subpoena Ad Testificandum — Orders a person to testify before a court, tribunal or deposition. Can require appearance by phone or in person.
Subpoena Duces Tecum — Orders a person or organization to bring physical evidence — most commonly documents or records — to a proceeding. This is the most frequently used type of subpoena.
Subpoenas to be served in New Jersey are usually issued by an attorney or the clerk of the court in the name of the judge presiding over the case. Typically subpoenas are formatted "in blank" and it is the responsibility of the lawyer to fill in the appropriate information and have the subpoena served by a New Jersey process server upon the witness.
Non-compliance with a properly served subpoena may be treated as contempt of court, resulting in fines or imprisonment. It is critical that subpoenas are served correctly and that proof of service is properly documented.
